| Resumo: | Historicamente a questão do meio ambiente vem sendo tratada pela legislação brasileira a partir de 1934. Contudo, apesar de existentes, tais legislações não eram capazes de compreender toda a vasta matéria ambiental, deixando a cargo da competência concorrente dos Estados e Municípios preencheram a lacuna da lei. O trabalho discute de forma analítica a questão da competência concorrente dos Estados membros para legislar sobre matéria ambiental, bem como a lei mineira 18023/2009, frente a existência de ato normativo federal, a Resolução do CONAMA 302/2002, e o advento do Novo Código Florestal 12651/2012 que tratam, de maneira diversa a questão da metragem de APP entorno de reservatórios artificiais de água em área rural. |
| Abstract: | Historically the issue of the environment has been treated by Brazilian law from 1934. However, despite existing laws such were not able to understand all the vast environmental matters, leaving to the concurrent jurisdiction of state and municipal law lled the gap. The paper discusses analytically the question of concurrent jurisdiction of member states to legislate on environmental matters, as analyzed the mining law 18023/2009, forward the existence of federal normative act, the CONAMA Resolution 302/2002, and the advent of the New Forest Code 12651/2012, dealing di erently the question of footage of APP around arti cial reservoirs of water in rural areas. |
