| Resumo: | O presente trabalho se propõe a analisar criticamente a Lei 11.340/2006, também conhecida no Brasil como “Lei Maria da Penha”, partindo de uma digressão histórica da legislação brasileira; primeiro analisando as conquistas que as mulheres obtiveram e depois o machismo e a influência que esse exerceu para o tratamento diferenciado da mulher na sociedade, o que refletiu nos dispositivos legais. Em seguida, com a apresentação da Lei Maria da Penha, será analisado o histórico da mesma e a maneira como as medidas protetivas podem ajudar a erradicar a violência doméstica no nosso país. Por fim, questiona-se a efetividade da prisão para o rompimento da violência doméstica, através de dados estatísticos e pesquisa bibliográfica. |
| Abstract: | This paper aims to critically analyze Act 11.340/2006, based on a historical tour of the Brazilian legislation; by first analyzing the achievements that women have obtained, then chauvinism and the influence that the latter had in the differential treatment of women in society, which reflected in legal provisions. After this, with the introduction of the Maria da Penha Act, the history of the Act is analyzed, as well as the way that protective measures can help eradicate domestic violence in our country. Finally, the effectiveness of imprisonment for disruption of domestic violence is questioned through statistics, articles and the doctrine. |
