| Resumo: | O presente trabalho tem como objetivo a realização de uma análise do Depoimento Especial, instituído através da Lei 13.431/17, trazendo à tona a necessidade de se interpretar o procedimento de acordo com os princípios consagrados pelo Estatuto da Criança e do Adolescente. Além disso, também serão realizadas críticas pontuais concernentes à influência que as falsas memórias possuem na oitiva das vítimas, trazendo, por fim, alternativas para uma melhor aplicação do procedimento, de forma a garantir o melhor interesse da criança. |
| Abstract: | This work aims to carry out an analysis of the Special Testimony, instituted through Law 13.431/17, highlighting the need to interpret the procedure according to the principles enshrined in the Statute of Children and Adolescents. In addition, specific criticisms will also be made concerning the influence that false memories have on the victims' hearing, bringing, finally, alternatives for a better application of the procedure, in order to guarantee the best interest of the child. |
