| Resumo: | Este artigo aborda como a neutralização da vítima no Processo Penal brasileiro fere seus diretos fundamentais e sua dignidade humana, tornando o processo injusto. Baseando-se na inconstitucionalidade desse tipo de tratamento dispensado à vítima, na Teoria Procedimentalista do Estado Democrático de Direito e na Teoria da Ação Comunicativa de Jürgen Habermas, o presente trabalho aponta para a importância de ampliar a participação da vítima no Processo Penal. |
| Abstract: | This article addresses how the neutralization of the victim in the Brazilian Criminal Procedure violates their fundamental rights and their human dignity, making the process unfair. Based on the unconstitutionality of this type of treatment of the victim, in the Proceduralist Theory of the Democratic State of Law and in the Theory of Communicative Action by Jürgen Habermas, this paper points out the importance of increasing the participation of the victim in the Criminal Procedure. |
