Quebrando o paradigma da “Lei de Imprensa” por meio do Distinguishing no CPC/15: a aplicação do método na interpretação da ADPF 130/DF proposto aos juízes e aos tribunais superiores à luz da teoria dos precedentes e do processo civil constitucional

Abstract

This present paper intends to analyze critically the interpretation given of precedent about “press act ” (ADPF 130/DF) tracing parameters, which will guide for the attempt to demystify the actual optical about freedom of expression's subject, instigating inquiries and reflections, in order to cause changes arising from that paradigm break. It’s given special focus to distinguishing's technical application in relation to judges and superior courts proposing the questioning and review about ADPF 130/DF in the light of theory of judicial precedent supporting on CPC/15 and constitutional civil procedure. In order to meet this objective, proposes with emphasis on application of distinguishing whenever that must to be necessary to guardianship the rights in vogue in individual cases, bearing, finally, the possibility of grant an inhibitory tutelage with legitimate way.
