Abstract

The object of this research turns first to identify the need to recast the Brazilian treatment given to foreign. Headlined by law 6.815 of 1980, the current treatment neglects constitutional principles and human rights. Alternatively, a new project was introduced in 2009, the bill 5655. This research is dedicated to verify whether such that project is able to respond to the needs that gave rise to it, adapting to the values that our society protects - and represents a real statute aimed at protecting the foreigner‟s rights - or if in fact it is a law eminently directed to immigration control in the country.
