| Resumo: | A presente pesquisa tem como escopo o estudo do instituto da prisão em flagrante no ordenamento jurídico brasileiro, com ênfase nas modificações incrementadas pela Lei 12.403/2011. A falta de precisão no texto legal possibilitou o surgimento de dúvidas, dando ensejo ao aparecimento de um embate doutrinário acerca das hipóteses flagrânciais que autorizam a violação de domicílio. Nessa toada, busca-se superar os conflitos argumentativos, a partir de uma análise que vislumbra o alcance de uma perspectiva inovadora sob o tema em comento. |
| Abstract: | This research is to study the scope of the institute's arrest in flagrante in the Brazilian legal system, with emphasis on changes incremented by Law 12.403/2011. The lack of precision in the legal text enabled the emergence of doubts, giving rise to the appearance of a clash about the doctrinal assumptions flagrânciais authorizing the violation of domicile. In this tune, seeks to overcome conflicts argumentative, from an analysis that sees the scope of a new perspective on the topic under discussion. |
