| Resumo: | O presente trabalho tem por objetivo dissecar o instituto da medida de segurança, de modo a apontar suas peculiaridades – prazos máximo e mínimo, formas de aplicação e execução - e consequentes incongruências, as quais culminam no completo desamparo aos portadores de sofrimento psíquico que cometem fatos definidos como crimes. Neste intento, o instituto será analisado pela ótica das diretrizes da reforma psiquiátrica do século XX, que visam superar a lógica hospitalocêntrica e só agora reverberam seus efeitos no ordenamento jurídico brasileiro. E o principal desses efeitos é o Projeto de Lei do Senado nº 163 de 2013, que busca conciliar as novas maneiras de abordagem ao portador de sofrimento mental infrator com a finalidade curativa e integrativa da medida de segurança, possibilitando o resgate da cidadania desses indivíduos. |
| Abstract: | The present paper intends to analyze the security measure institute, in order to point out its peculiarities – maximum and minimum terms, the forms of application and execution – and its following inconsistencies, which culminate in the complete abandonment of those with mental suffering who commit crimes. In this purpose, the institute will be examined from the perspective of the guidelines of the twentieth century psychiatric reform, which aims at overcoming the logic centered in mental hospitals, and only now reverberate its effects in the Brazilian legal system. And its main effect is the Senate Bill nº 163 of 2013, which seeks to reconcile the new ways of approaching the lawbreaker with mental suffering with the healing and integrative purpose of the security measure, making it possible to rescue the citizenship of these individuals. |
