| Resumo: | O presente trabalho tem o objetivo de discorrer sobre a Lei 12.654/12, a qual instituiu a possibilidade de se utilizar material genético para descoberta da autoria de delitos no curso de investigações criminais, bem como estabeleceu a obrigatoriedade de os condenados por crimes hediondos ou crimes cometidos com violência grave contra a pessoa fornecerem material genético para formação de banco de dados. Neste sentido, pretende-se analisar a constitucionalidade da referida lei por colidir com o princípio da não-autoincriminação, garantia fundamental do acusado de observância obrigatória. Pretende-se, ainda, analisar os aspectos da lei que não foram suficientemente regulamentados. |
| Abstract: | This academic assignment aims to discuss about the Ordinary Law Nº12.654/12, which created the possibility to use genetic material to uncover the perpetrator of an offense in the course of criminal investigations, as well as establish the mandatory supply of genetic material by criminals sentenced for heinous crimes or crimes committed with severe violence. In this matter, this work intends to analyze the constitutionality of the referred law for colliding with the principle of the non-autoincrimination, fundamental guarantee of the accused of mandatory observation. It is intended, furthermore, analyze the aspects of the law which weren’t sufficiently regulated. |
