| Resumo: | O presente estudo tem como objetivo principal a mediação no Novo Código de Processo Civil e uma análise pormenorizada mediante uma ótica reflexiva e principiológica deste instituto. Pretende-se evidenciar, a partir dos princípios que orientam a mediação, que a essência desta deva ser resguardada para um estímulo ao uso da mediação. Busca-se desconstruir aspectos procedimentais e legais da audiência de mediação, mediante crítica direcionada ao art. 334 do NCPC/15, com a consequente inovação da audiência de mediação trazida pelo código. O desenvolvimento dos questionamentos e reflexões que justificam a presença da mediação no NCPC/15 serão fundamentados com base na autonomia da vontade, que caracteriza o mecanismo consensual que representa o instituto da mediação. |
| Abstract: | The present study has as main objective the mediation in the New Code of Civil Procedure and a detailed analysis through a reflective and principiological perspective of this institute. It is intended to evidence, from the principles that guide mediation, that the essence of this should be safeguarded for a stimulus to the use of mediation. It seeks to deconstruct procedural and legal aspects of the mediation hearing, through criticism directed to art. 334 of the NCPC / 15, with the consequent innovation of the mediation hearing brought by the code. The development of the questions and reflections that justify the presence of mediation in NCPC / 15 will be based on the autonomy of the will, which characterizes the consensual mechanism represented by the mediation institute. |
