| Resumo: | A relação entre empregado e empregador é caracterizada por ser conflituosa, constituindo um campo apto a gerar a responsabilização do empregador em virtude de violações aos Direitos Fundamentais dos empregados. O presente artigo tem por objetivo examinar a aplicação dos Direitos Fundamentais nas revistas íntimas realizadas pelo empregador ou por seus prepostos nos empregados, no ambiente de trabalho, bem como analisar potenciais violações a esses direitos, quando o empregador exceder na sua prerrogativa. Verificar-se-á se esses procedimentos estão em conformidade com os ditames legais acerca do tema, merecendo especial consideração a Lei nº 13.271, de abril de 2016, que dispõe sobre a proibição de revista íntima de funcionárias e clientes do sexo feminino. |
| Abstract: | The relationship between employer and employee has always been a conflictual one, providing a suitable field for employer responsabilization due to violations of fundamental rights of the employees. This article aims to apply the approach of fundamental rights to worker's body searches by the employer or his agents, as well as the analysis of potential violations of those rights when the employer exceeds in his prerogative. It also analyses whether those procedures are in compliance with legal directives on the subject; meriting special consideration Law nº 13.271, of April 2016, which regulates the ban on body searches on female employees and female clients in the workplace. |
