| Resumo: | O presente estudo buscou investigar o regime jurídico aplicável ao contrato de franquia empresarial com a promulgação da Lei no 13.966/19 e de como a atual regulação da matéria dialoga e reage às dificuldades enfrentadas sob a vigência da Lei no 8.955/94. Ademais, a pesquisa também procurou identificar se a nova regulação da franquia empresarial faz parte de uma tendência de afirmação da autonomia jurídica dos contratos empresariais no ordenamento jurídico brasileiro. Para tanto, o estudo valeu-se do método de revisão bibliográfica e jurisprudencial. Ao final, o estudo conclui pelo aprimoramento do regime jurídico da franquia empresarial, com a superação de muitos dos dilemas enfrentados anteriormente e com a incorporação dos princípios próprios dos contratos empresariais. |
| Abstract: | The present study investigates the legal regime applicable to the business franchise with the enactment of the Law no 13.966/19 and how the current regulation of the matters dialogues and reacts to the difficulties faced under the Law no 8.995/94. Furthermore, the research also sought to identify whether the new regulation of the business franchise is part of a trend of affirming the legal autonomy of business contracts in the brazilian legal system. To this end, the study used the method of bibliographic and jurisprudential review. In the end, the study concludes that the legal regime of the business franchise has been improved, overcoming many of the dilemmas faced previously and incorporating the principles specific to business contracts. |
