| Resumo: | O presente trabalho versa sobre o papel da rede de proteção à criança e adolescente diante da Lei no 14.344, de 24 de Maio de 2022 (Lei Henry Borel), a qual cria mecanismos para a prevenção e o enfrentamento da violência doméstica e familiar contra a criança e adolescente através da atuação do Microssistema de Garantias de Direitos Infantojuvenis, que constitui em um conjunto normativo que trazem medidas assistenciais e protetivas que são imprescindíveis para que busque-se, com base na Doutrina da Proteção Integral, a tutela de direitos fundamentais inerentes às crianças e adolescentes. Desse modo, neste trabalho analisaremos como se dará a aplicação do microssistema, uma vez que o manejo e a prática do novel diploma legal irão delimitar o alcance e a pertinência dos novos institutos que tutelam os direitos do público infantojuvenil vítima ou testemunha de violência doméstica e familiar. |
| Abstract: | This work deals with the role of the child and adolescent protection network in light of Law No. 14,344, of May 24, 2022 (Henry Borel Law), which creates mechanisms for preventing and confronting domestic and family violence against children and adolescents through the actions of the Microsystem of Guarantees of Rights for Children and Adolescents, which constitutes a set of regulations that provide assistance and protective measures that are essential to seek, based on the Doctrine of Integral Protection, the protection of fundamental rights inherent to children and teenagers. Therefore, in this work we will analyze how the microsystem will be applied, since the management and practice of the new legal diploma will delimit the scope and relevance of the new institutes that protect the rights of children and adolescents who are victims or witnesses of domestic violence and familiar. |
