Trabalho plataformizado: vínculo de emprego e horizonte reivindicativo de direitos

Abstract

The present work aims to analyze the relationship between labor legislation, the Brazilian legislated model and the formation of the working class, with regard to the support of demands for the implementation of the rights provided for by law and their expansion, and how this applies in the context of platform workers, treated as self-employed. Based on the theoretical research carried out, we sought, through bibliographical and legal review, to understand the horizons of possibilities of platform workers in the face of the weakening of negotiating and fiscal power, in addition to the divergent positioning in the Labor Court regarding the employment relationship and negative at the Federal Supreme Court. In this sense, the lowering of protection for these workers through the neoliberal context and labor reforms since 2016 seems to place them on a historical level beyond precariousness, in which demands for specific gains prevail, to the detriment of demands regarding application of labor legislation. This agenda has been channeled to the Labor Court, especially based on the individual actions of each worker, becoming a privileged stage for the dispute between capital and labor.
