| Resumo: | O presente trabalho possui como tema central a problemática do fornecimento de medicamentos não inscritos na lista do Sistema Único de Saúde por parte do Estado, por meio das vias judiciais, no atual contexto de crise fiscal e política enfrentada pelo Poder Público no Brasil. Para isso, será abordada a dificuldade de acessibilidade a esses medicamentos enfrentada por parcela significativa da população brasileira. Neste sentido, será considerada a atuação do Poder Judiciário como garantidor da efetivação do direito à saúde, por meio da realização de políticas públicas relativas à matéria, observados os princípios e limites constitucionais. |
| Abstract: | The present work has, as its central theme, the problem of the supply of medicines not included in the list of the Unified Health System by the State, through judicial means, in the current context of fiscal and political crisis faced by the Public Power in Brazil. The difficulty of accessibility to these drugs faced by a significant portion of the Brazilian population will also be addressed. It will also be the role of the Judiciary as guarantor of the realization of the right to health, through the realization of public policies related to the matter, in line with constitutional principles and limits. |
