Modernização do judiciário: análise da informatização do judiciário a partir da implementação do legal design

Abstract

This work aims to present the concept of Legal Design and how this approach can serve as a modernization and integration mechanism when developing systems and platforms that make the provision of jurisdiction by the Judiciary more flexible and rational. As a methodological strategy, a bibliographical review was carried out, complemented by a hypothetical-deductive analysis, through a descriptive study. The procedures used were content analysis, documental, doctrinal and legislative collection and analysis. From this, we sought to analyze the incorporation of digital platforms to expand access to the Judiciary, as well as to reduce delays in the provision of jurisdiction. In addition, it was intended to verify the causes of the crisis of the Brazilian Judiciary and how its members acted in an attempt to circumvent it. Finally, there is the presentation of examples of platforms and digital systems introduced in the Judiciary and the impact caused by this computerization, being discussed positive and negative points.
