| Resumo: | A finalidade do presente estudo é tecer exame sobre a técnica de ampliação de julgamento introduzida no artigo 942 do Código de Processo Civil de 2015, em substituição aos extintos embargos infringentes. O trabalho foi construído através de pesquisa bibliográfica, possibilitando o confronto entre posicionamentos doutrinários e a análise dos precedentes jurisprudenciais, sobretudo o entendimento firmado pelo Superior Tribunal de Justiça sobre a temática. Concluiu-se que não obstante os dificultadores práticos, a nova técnica se amolda aos ideais promovidos pela reforma de 2015 de alcance do princípio da celeridade processual e da segurança jurídica. |
| Abstract: | The main purpose of this study is to examine the technique of extending judgment introduced in article 924 of the 2015 Code of Civil Procedure, replacing the extinct Infringing Embargoes. The work was built through extensive bibliographical research, enabling the confrontation between doctrinal positions and the analysis of jurisprudential precedents, especially the position established by the Superior Court of Justice on the subject. It is thus concluded that, despite the practical complications, the new technique conforms to the ideals promoted by the 2015 reform, thus promoting the principle of procedural speed and legal certainty. |
