Incidente de resolução de demandas repetitivas: análise do acesso à justiça na formação da decisão no caso do desastre de Mariana/MG

Abstract

This paper addresses the issue of the need for greater uniformity regarding the numerous judgments of cases pending in certain courts and one of the instruments used for this, which is the Repetitive Claims Resolution Incident. This incident was established in the Code of Civil Procedure, in the list of mandatory precedents, aiming at the analysis and identification of processes with repetitive objects for a joint assessment, as a way to avoid different decisions on the same matter, when there is a risk of offense to isonomy and legal certainty. It also seeks to relate the difficulty of accessing justice in Brazil and how this influences the formation of theses through the IRDR. Finally, the problematic introduction of the IRDR in the case of the Mariana disaster caused by the Samarco company will be analyzed.
