Direito à educação e inclusão das pessoas com surdez

Abstract

This article aims to analyze the international and brazilian laws under the perspective of the social model of disability and human rights, especially the right to education. The specific situation of the deaf community will be addressed by taking in into account their linguistic peculiarity and the identity construction process of the deaf subject, as well as approaching the historical evolution of federal and municipal legislative provisions. Finally, it is hoped to demonstrate that the deaf community’s right to a bilingual education, which has been widely regulated, is also a cultural matter and hasn’t been effectuated through the public policies that the law suggests. Moreover, it is intended to present some contribution to the social movement of the deaf in Juiz de Fora by giving some argumentative substrate to its claiming for rights in the local court and municipal government, aside from the Inter-American Court of Human Rights.
