| Resumo: | O presente trabalho aborda a questão da competência para a lavratura do Termo Circunstanciado de Ocorrência, que vem causando muita divergência de interpretação entre a doutrina e jurisprudência, uma vez que era realizado somente pela polícia judiciária, mas atualmente as polícias militares também fazem a confecção desta peça informativa em diversos estados brasileiros. Para trazer a discussão à tona, analisaremos os objetivos e princípios norteadores da Lei 9.099/95, que criou os Juizados Especiais Cíveis e Criminais e instituiu o Termo Circunstanciado, abordando também os entendimentos da doutrina e da jurisprudência, chegando ao entendimento de que a interpretação ampliativa da competência para a lavratura do TCO é a mais adequada à nossa realidade jurídica e social. |
| Abstract: | The paper addresses the issue of competence for drafting the Circumstantiated Occurrence Term, which has caused a great deal of divergence of interpretation between doctrine and jurisprudence, since it was carried out only by the judicial police, but currently the military police also make this piece information in several Brazilian states. To bring the discussion to the fore, we will analyze the objectives and guiding principles of Law 9.099/95, which created the Special Civil and Criminal Courts and instituted the Term Circumstantiated, also addressing the understandings of doctrine and jurisprudence, arriving at the understanding that the interpretation extension of the competence to draw up the TCO is the most appropriate to our legal and social reality. |
