| Resumo: | O presente trabalho tem como objetivo analisar a serendipidade e a admissibilidade das informações obtidas ao acaso por meio de interceptações telefônicas. Através da pesquisa jurisprudencial e doutrinária, busca-se o melhor posicionamento quanto à utilização processual, estabelecendo um limite para a utilização da medida, por meio de interpretação conforme a Constituição. Além disso, para evidenciar a complexidade do tema, investiga-se a problemática do encontro fortuito quanto à Operação Lava Jato, trabalhando-se com a parte inicial da investigação. Ao final, conclui-se pela inadmissibilidade dos conhecimentos acidentais sem relação com a situação histórica da investigação que deu ensejo à medida, considerando o papel do Direito Processual Penal no Estado Democrático de Direito. |
| Abstract: | The present work has as objective to analyze the serendipity and the admissibility of the information obtained at random through telephone wiretapping. With jurisprudential and doctrinal research, the best positioning in relation to the procedural use is sought, establishing a limit for the use of the measure, by means of interpretation according to the Constitution. In addition, in order to highlight the complexity of the topic, the problem of the fortuitous encounter regarding Operation Carwash is investigated, working with the initial part of the investigation. In the end, it’s concluded that the accidental knowledge unrelated to the historical situation of the investigation that gave rise to the measure is inadmissible, considering the role of Criminal Procedural Law in the Democratic State Ruled by Law. |
