| Resumo: | O presente trabalho acadêmico tem por objetivo analisar uma aparente inconstitucionalidade da atual posição do Supremo Tribunal Federal acerca da execução provisória da pena. Para tanto, há uma análise sistêmica do nosso próprio ordenamento jurídico, de outras decisões do próprio Supremo Tribunal Federal e também de tratados e convenções internacionais. Deste modo, com a possibilidade da execução provisória da pena, o principio constitucional da presunção de inocência estaria sendo suprimido, aniquilando um dos direitos mais caros à manutenção do nosso regime democrático. |
| Abstract: | The objective of this academic paper is to analyze an apparent unconstitutionality of the current position of the Federal Supreme Court regarding the provisional execution of the sentence. Therefore, there is a systemic analysis of our own legal system, other decisions of the Federal Supreme Court itself and also international treaties and conventions. Thus, with the possibility of provisional execution of the sentence, the constitutional principle of the presumption of innocence would be abolished, annihilating one of the most expensive rights to the maintenance of our democratic regime. |
