| Resumo: | O presente trabalho tem como escopo discutir a excepcional possibilidade de penhora parcial da remuneração em face de execuções de débitos desprovidos de natureza alimentar. A mitigação dessa regra se dá sob a ótica do neoconstitucionalismo, de forma a encontrar um ponto de equilíbrio entre os interesses em jogo, quais sejam, a dignidade da pessoa humana do executado e a efetividade da tutela jurisdicional vindicada pelo exequente, sem perder de vista a análise das particularidades do caso concreto. |
| Abstract: | The purpose of this paper is to discuss the possibility of partial attachment of the remuneration, in face of executions of debt without food character. The mitigation of this rule comes from the perspective of neo-constitutionalism, in order to find a balance between the interests at stake, namely, the dignity of the human person executed and the effectiveness of judicial protection vindicated by the executor, without losing sight of the analysis of the particularities of the specific case. |
