| Resumo: | O presente trabalho tem por objeto a análise crítica da chamada fase de investigação social dos concursos públicos, especialmente aqueles voltados para carreiras da área de segurança pública. As principais questões a serem enfrentadas são a natureza e a razoabilidade dos requisitos objetivos e subjetivos que têm sido empregados para realização de tal etapa avaliativa nos certames. Valendo-se de análise detida do posicionamento jurisprudencial e doutrinário a respeito do tema, pondera-se a constitucionalidade dos critérios adotados quando da existência de infrações (apuradas em procedimento administrativo ou processo judicial com sentença condenatória ou não) na vida pregressa do candidato frente, principalmente, aos princípios da presunção de inocência e da limitação das penas. |
| Abstract: | The present study approaches the so-called "social research phase" of public tenders, focusing mainly on those specifically for careers public safety careers. The research problem lay on the nature and reasonableness of the objective and subjective criteria that have been used to carry this evaluative stage in the contests. Based on an analysis of the jurisprudential and doctrinal positions about the subject, we question the constitutionality of the criteria adopted when there are infractions (whether ascertained in a judicial process with condemnation or not) in the previous life of the candidate, mainly in relation to the principles of presumption of innocence and the prohibition of perpetual punishments. |
