| Resumo: | O Direito de Família encontra-se em constante evolução, sobretudo diante dos novos anseios da sociedade. No curso desta evolução e, principalmente, após a promulgação da Constituição Federal de 1988, novas formas de entidades familiares passaram a ser reconhecidas no ordenamento jurídico pátrio, e não somente aquelas formadas por pai, mãe e filhos. O princípio da afetividade ligado ao direito fundamental à felicidade passou a fundamentar as relações familiares, surgindo a possibilidade jurídica da multiparentalidade como nova forma de filiação, tese recentemente enfrentada pelo Supremo Tribunal Federal por meio do RE 898.060/SC, sendo objeto de intensa discussão no âmbito do Direito de Família, principalmente no que tange aos seus efeitos práticos e aos obstáculos a serem enfrentados. |
| Abstract: | Family law is in constant evolution, above all in face of society's new yearnings. In the course of this evolution and, mainly, after the promulgation of the Federal Constitution of 1988, new shapes of family entities became recognized in the national legal order, and not only those formed by father, mother and children. The affectivity principle linked to the fundamental right of happiness started to substantiate family relationships, arising the legal possibility of multi-parenthood as a new shape of filiation, a thesis that was recently faced by the Brazilian Supreme Court though RE 898.060/SC, being object of an intense discussion at the scope of family law, mainly in reference of its practical effects and the obstacles to be faced. |
