| Resumo: | A presente monografia tem por objetivo analisar o conceito tradicional de precedente judicial e os seus desdobramentos no ordenamento jurídico brasileiro, contrapondo sua concepção clássica com a sua aplicação no Brasil, considerada como “precedente à brasileira”. Para tanto, será analisado o Incidente de Resolução de Demandas Repetitivas como uma importante inovação trazida pelo Código de Processo Civil de 2015 a fim de garantir a isonomia e segurança jurídica, privilegiando a razoável duração do processo, a igualdade, efetividade, previsibilidade e racionalidade das decisões judiciais. Neste sentido, será realizado o estudo da tese firmada no primeiro Incidente de Resolução de Demandas Repetitivas referente ao direito à saúde, observando seu impacto e benefícios na prestação jurisdicional de demandas que efetivam tal direito fundamental. Através de uma metodologia dedutiva, com pesquisa qualitativa, bibliográfica e estudo de caso, conclui-se que o referido incidente proporcionará uma maior efetividade das demandas repetitivas de interesse público. |
| Abstract: | This paper aims to analyze the traditional concept of binding precedent and its developments in the Brazilian judicial system, contrasting its classical conception with its application in Brazil, considered as "Brazilian precedent". To this end, the Repetitive Demans Resolution Incident will be analyzed as an important innovation brought by the Civil Procedure Code of 2015 in order to guarantee isonomy and legal security, favoring the reasonable duration of the process, equality, effectiveness, predictability and rationality of the judicial decisions. In this way, the study of the thesis signed in the first Repetitive Demans Resolution Incident will be carried out regarding the right to health, observing its impact and benefits in the jurisdictional provision of demands that materialize that fundamental right. Through a deductive methodology, with qualitative and bibliographic research and case study, it is possible to conclude that the mentioned incident will provide a greater effectiveness of the repetitive demands of public interest. |
