Análise crítico reflexiva das medidas preventivas e sancionatórias atinentes aos deveres parentais de convivência e participação na vida da criança e do adolescente

Abstract

This paper aims to provide a critical and reflective analysis of the preventive and sanctioning measures regarding parents‟ support in their children‟s lives. The research was developed through an analysis made since the old civil code, from 1916, to the present day, by studying the changes that have occurred in our society, the implementation of new laws that regulate the rights of children and teenagers and the rights acquired during all these years, including the institution of the Civil Code of 2002, the promulgation of the Federal Constitution of 1988, the Child and Adolescent Statute (Estatuto da Criança e do Adolescente), the Shared Custody Law (Lei da Guarda Compartilhada), the Parental Alienation Law (Lei da Alienação Parental) and the bill that deals with the criminalization of Parental Alienation. The research intends to show evidence that the law does not insure a solution that is adequate and satisfactory to the problem of parents‟ absence of coexistence with their children, either by parental alienation or the lack of will to relate, aiming to achieve the minor‟s best interest for a healthful growth.
