| Resumo: | O presente trabalho conjuga a fórmula de Claus Roxin com o poder discricionário do Delegado de Polícia, defendendo a aplicação de vanguarda do princípio da insignificância na atividade policial, de forma a permitir que a autoridade policial deixe de iniciar um inquérito ou de ratificar um Auto de Prisão em Flagrante quando o fato for atípico tendo em vista a incidência do princípio em análise. Buscou-se demonstrar que a edição da lei 12.830/13, que deu maior liberdade para a autoridade policial, reafirmou essa possibilidade, cabendo ao delegado de policia não só a analise formal da tipicidade, mas também seu aspecto material. |
| Abstract: | This work combines the formula Claus Roxin with the discretion of the Chief of Police, advocating the application of the principle of insignificance forefront in police activity in order to allow the police authority fails to initiate an investigation or ratify an Auto Caught in prison when the fact is atypical in view of the implications of the principle in question. We attempted to demonstrate that the issue of law 12.830/13, which gave greater freedom to the police authority, reaffirmed this possibility, being the chief of police not only the formal analysis of typicality, but also its material aspect. |
