| Resumo: | O presente trabalho versa sobre as justificativas utilizadas pelos defensores da tese de que as normas trabalhistas que foram convencionadas entre as partes, em negociação coletiva, se sobreponham às normas legais, sobretudo à CLT. Tomando como ponto de partida as ideias de alguns autores que se debruçaram sobre o tema, serão analisadas as principais justificativas apresentadas, visando descobrir se os argumentos utilizados nessa proposta de flexibilização são capazes de sustentá-la. |
| Abstract: | The present study discusses the arguments used by the proponents of the thesis that the established labor standards between employer and employee, in collective agreement, overlap the legal rules, especially CLT (Labor Laws Consolidation). Taking as a starting point the ideas of authorities of the theme, it will be analyzed the main justifications presented, in order to find out if the arguments used on this outline are capable of sustaining it. |
