| Resumo: | O presente trabalho busca analisar a responsabilização civil dentro do contexto do estacionamento rotativo conhecido como “Área Azul” ou “Zona Azul”. Examina-se a responsabilização por eventuais danos ou furtos de veículos que permanecem no estacionamento rotativo. Pretende-se fazer um estudo específico da questão dentro do município de Juiz de Fora, estudando inicialmente o Decreto n.º 12.278 de 2015 que regula o serviço na cidade. Em um segundo momento, avalia-se como a responsabilidade civil do Estado é compreendida no contexto jurídico contemporâneo. Por fim, pondera-se a compatibilidade jurídica do Decreto n.º 12.278 com a noção de responsabilidade civil do Estado a fim de se analisar posição da administração pública municipal perante o caso. |
| Abstract: | The present work seeks to analyze the civil responsibility within the context of the rotary parking known as "Blue Area" or "Blue Zone”. Responsibility for possible damage or theft of vehicles left in the rotating parking lot is examined. It is intended to make a specific study of the issue within the municipality of Juiz de Fora, initially studying Decree No. 12.278 of 2015 that regulates the service in the city. In a second moment, it is evaluated how the civil responsibility of the State is understood in the contemporary juridical context. Finally, it is considered the legal compatibility of Decree No. 12.278 with the concept of civil responsibility of the State in order to analyze the position of the public administration in the case. |
