| Resumo: | O impulso para o desenvolvimento deste trabalho despontou da análise das implicações que o novo Código de Processo Civil poderia gerar para a prática jurídica. Destaca-se que a legislação restringiu a possibilidade de interposição de agravo de instrumento, tornando-o meio de impugnação de decisões interlocutórias previstas em rol taxativo. No contexto de crise do sistema recursal brasileiro, buscou-se solucionar possíveis controvérsias acerca da irrecorribilidade imediata das decisões judiciais anteriores à sentença e a utilização do mandado de segurança como sucedâneo recursal, a fim de impugnar decisões interlocutórias não agraváveis. |
| Abstract: | The purpose of this paper is to the analyse the implications that the brazilian New Civil Procedure Code would create to Law practice. Stands out that this new Code restricted the possibility for interlocutory appeal, making it a way to challenge its decisions, prevised in a restrictive list. In the context of brazilian recourse system crises, there are been searched ways to solve the irrecobility controversy upon decisions made before the sentence and the possibility of using injuction as a synonym of recourse to challenge decisions that can not be appealed. |
