Abstract

This article aims to analyze the shared custody under the genre perspective. For this purpose, a brief historical review of the family concept and a brief view of genre were fulfilled. Century XX feminist theories were used as theoretical framework, mainly the theory of the North-American researcher Joan Scott. The new perception of the democratic family assumes possibilities of different experiences lived by men and women. By granting majority of unilateral custody to women, overloads the mother, keeping the father as a supporting role on the children´s creation, making it visible that, even on current days, propagates the vision of the provider father and the caregiver mother. In this work, therefore, it is intended to demonstrate that shared custody is an important instrument for changing conceptions about gender relationships and the role of men and women as fathers and mothers.
