| Resumo: | O texto aborda dois grandes institutos do ordenamento jurídico brasileiro, quais sejam, a coisa julgada e a súmula vinculante. É traçada as linhas gerais de cada instituto, ressaltando os pontos mais relevantes e mais controversos na doutrina, para que ao final, se possa com clareza relacionar os dois institutos entre si,demonstrando a incidência do efeito vinculante da súmula sobre a coisa julgada,as possibilidades de relativização e a necessidade do reforço de sua autoridade, mostrando como se deu, no ordenamento jurídico brasileiro, a aproximação das famílias do civil law e do common law através da adoção da súmula vinculante, trazida pela Emenda Constitucional nº45/2004. |
| Abstract: | The text covers two major Brazilian legal institutes, which are, at the iudicata and summarising binding. Is drawn the general lines of each Institute, highlighting the points more relevant and more controversial in the doctrine, so that in the end, it can clearly relate the two institutes among themselves, demonstrating the impact of binding effect of the docket on iudicata relativization opportunities and the need to strengthen their authority, showing how they gave, in the Brazilian legal system, the families of civil law and common law docket through the adoption of binding, brought by constitutional amendment nº 45/2004. |
