| Resumo: | O escopo do presente trabalho é verificar a responsabilidade subsidiária da Administração Pública nos casos de terceirização. O tema foi escolhido devido à atualidade e relevância dos conflitos que lhe são decorrentes, em virtude da intensa utilização dessa forma de relação de trabalho pelos entes públicos. O enfoque dar-se-á a partir da aplicabilidade da Súmula 331 do TST e sua capacidade de assegurar aos trabalhadores uma tutela jurisdicional que efetive as garantias trabalhistas previstas no ordenamento pátrio, preservando também os interesses da coletividade, afim de construir uma sociedade justa e harmônica. Examina-se a posição do STF quanto à tutela prevista na Súmula 331 do TST. |
| Abstract: | The scope of this work is to verify the subsidiary responsibility of the Public Administration for the outsourcing. The theme was chosen because of the timeliness and relevance of conflicts that are arising due to the intense use of this form of working relationship by public entities. The focus will be given from the applicability of Statement 331 of the TST and its ability to provide effective jurisdictional protection to the labor guarantees provided by the national legal system, preserving the collective interests in order to build a harmonic and just society. It examines the position of the STF on the protection provided in the Statement of the TST 331. |
