| Resumo: | A presente monografia tem como objetivo demonstrar a discussão que permeia a responsabilidade civil dos provedores dos sites das redes sociais da internet nas hipóteses em que se configura o dano moral. Para tanto, há uma breve elucidação acerca do funcionamento destes sites, buscando demonstrar a especificidade do serviço que é fornecido ao usuário. Analisa-se a aplicabilidade da responsabilidade civil objetiva, fundamentada, ora na cláusula geral de responsabilidade objetiva contida no artigo 927, parágrafo único, do Código Civil de 2002, ora no Código de Defesa do Consumidor, defendendo, ao final, a adoção da responsabilidade civil subjetiva, baseada na culpa. |
| Abstract: | This monography aims to demonstrate the discussion that permeates the civil liability of providers of social networking sites on the Internet in the event that sets the moral damage. For this, there is a brief clarification about the operation of these sites, seeking to demonstrate the specificity of the service is provided to you. Analyzes the applicability of the liability objective, reasoned, sometimes on the general clause of strict liability contained in article 927, paragraph one, of the Civil Code of 2002, now in the Code of Consumer Protection, defending, at the end, the adoption of subjective liability, based on guilt. |
