| Resumo: | O presente estudo tem como objetivo analisar as diferentes intervenções do Poder Judiciário frente às lides decorrentes dos contratos do Sistema Financeiro da Habitação, principalmente no que tange ao saldo devedor residual. Nesse sentido, é analisada a função teleológica da Lei 4.380/1964, os divergentes fundamentos adotados pelos tribunais, bem como o posicionamento doutrinário pertinente ao tema do financiamento habitacional. Busca-se, ao final, uma solução consentânea com a efetiva tutela do contratante, a fim de coibir o abuso em tais relações. |
| Abstract: | This study aims to analyze the different interventions of the judiciary labors under forward contracts at the Housing Finance System, especially regarding the residual debit. Accordingly, we analyze the role of teleological Law 4.380/1964, the divergent fundamentals adopted by the courts, as well as the doctrinal position concerning the matter of housing finance. Looking up at the end, a solution consistent with the effective supervision of the contractor in order to curb abuse in such relationships. |
