| Resumo: | Este trabalho tem como objeto a análise da possibilidade de aplicação da teoria das cargas probatórias dinâmicas como instrumento de concretização do direito ao acesso à justiça na perspectiva da terceira onda renovatória explicitada por Cappelletti e Garth. Será demonstrado que a aplicação dessa teoria se legitima através de uma interpretação sistemática da Constituição Federal e do Código de Processo Civil. Ao final, será abordada a forma como o Projeto de Lei 8.046/10 regula a teoria, adentrando-se nas divergências doutrinárias e demonstrando como a jurisprudência se posiciona frente à questão. |
| Abstract: | This essay aims to analyze the possibility of application of the dynamic allocation of burden of proof theory as an instrument for realization of the right to access to justice in connection with the third wave renewals explained by Cappelletti and Garth. It will be demonstrated that the application of this theory is legitimized through a systematic interpretation of the Federal Constitution and the Code of Civil Procedure. At the end, will be approach how the Bill Project 8.046/10 regulates the theory, entering on the doctrinal divergences and demonstrating how the jurisprudence deals with it. |
