| Resumo: | O presente estudo tem por finalidade analisar o papel do Direito na regulação do exercício da cura, especificamente a Kardecista, uma via alternativa de assistência à saúde. O código Penal tipifica curandeirismo como um crime contra a saúde pública. Contudo, o ordenamento se demonstra ultrapassado, devendo-se haver proporcionalidade entre a liberdade do sujeito e a tutela jurisdicional estatal, alcançando-se, desta forma, efetivamente o status de Estado Democrático de Direito. Uma vez que todo cidadão tem o direito de optar pelo método de cura e de promoção da saúde que mais achar cabível à respectiva situação; e de que o Estado deve atender aos interesses de seus tutelados que por sua vez não necessitam de repressão e sim de sua intervenção em prol da sua segurança jurídica. |
| Abstract: | The study aims to analyze the role of law in regulating the exercise of faith healing, specifically “Kardecista”, an alternative way of health care. The Penal Code criminalizes faith healing as a crime against public health. However, the system is outdated and should be proportionality between freedom of the individual and the state judicial protection, is reaching out in this way, effectively the status of a democratic state. Since every citizen has the right to choose the method of healing and health promotion to find more appropriate to their situation, and that the state must serve the interests of their subjects which in turn does not require suppression but of intervene in favor of their legal certainty. |
