| Resumo: | O presente trabalho tem como objetivo analisar a natureza jurídica do direitodever aos alimentos da relação familiar, bem como o fundamento destes após a dissolução do casamento, em que é necessário fazer uma ponderação entre o direito de liberdade e o direito fundamental de solidariedade, buscando sempre a igual dignidade social. Devem ser consideradas, ainda, possíveis causas de exclusão no que se refere ao direito aos alimentos, bem como a natureza jurídica do termo “condição social”, introduzido no artigo 1.694 do Código Civil Brasileiro. Questiona-se, ainda, o cabimento da prestação alimentar em determinadas situações, mais especificamente após o divórcio, tomando por parâmetro o princípio da solidariedade familiar e mútua assistência, sendo, todavia, limitados pela liberdade individual. |
| Abstract: | This study aims to analyze the legal nature of the food right of the family relationship, as well as the foundation of these after the marriage dissolution, where it is necessary to make a judgment between the freedom right and the solidarity fundamental right, always seeking the equal social dignity. It also should be considered possible causes of exclusion with regard to the food right, as well as the legal nature of the term "social condition", introduced in article 1.694 of the Brazilian Civil Code. Is still needed to be questioned the food right in certain situations, more specifically after the divorce, taking as parameter the principle of family solidarity and mutual assistance, being, however, limited by individual freedom. |
