| Resumo: | O presente trabalho tem como objetivo apresentar uma visão garantista sobre todo o ordenamento processual brasileiro, em consonância com o sistema processual acusatório adotado pela Constituição. Observados os principais fatores históricos concernentes ao desenvolvimento dos sistemas processuais penais e realizada breve leitura sobre o garantismo penal elaborado por Luigi Ferrajoli, caberá analisar a conformidade do ordenamento jurídico aos princípios e normas instituídos pelo Estado Democrático de Direito, sem deixar de mencionar as recentes alterações legislativas e o Projeto de Novo Código de Processo Penal. |
| Abstract: | This paper aims to present a “garantistic” vision over the entire Brazilian procedural law, in line with the adversarial system adopted by the Constitution. Having the main historic factors concerning to the development of the criminal procedural systems observed and a brief reading over the criminal “garantism” elaborated by Luigi Ferrajoli performed, it will be worth analyzing the conformity of the law to the principles and rules established by the Democratic State of Law, not to mention the recent legislative changes and the New Criminal Procedure Code Bill. |
