| Resumo: | O trabalho proposto insere-se dentro do campo do Direito Civil e Constitucional, referindo-se a importância do conhecimento da identidade genética no desenvolvimento do indivíduo, na formação de sua personalidade e na sua inserção na sociedade. Levando-se em conta a ausência de legislação específica no que concerne a reprodução assistida heteróloga e a relação entre aqueles que dela participam e o indivíduo gerado, busca-se descobrir como a criança gerada através da reprodução in vitro é afetada e até que ponto é viável o sigilo do doador de sémen. Conclui-se que o direito à origem genética, como direito fundamental essencial ao indivíduo, deve ser garantido à pessoa concebida através da inseminação heteróloga, sem, contudo, cogitar a existência do estado de filiação entre esta e o doador. |
| Abstract: | The aim of this study is to insert in the civil and constitutional law field, referring to the importance of knowledge of the genetic identity in the development of the individual, in the formation of its personality and its integration into society. Considering the lack of specific legislation concerning the heterologous assisted reproduction and the relationship between those who participate and the individual generated, we try to figure out how the child generated by in vitro reproduction is affected and to what extent the confidentiality of semen donor is feasible. It follows that the right to genetic origin as an essential fundamental right of the individual, must be guaranteed to the person conceived through heterologous insemination, without, however, entertain the existence of the state of affiliation between this and the donor. |
