| Resumo: | A apuração de transgressões disciplinares graves, cometidas no âmbito da Polícia Militar de Minas Gerais, por força de lei, deve respeitar o devido processo legal e os direitos e garantias assegurados pela Constituição Federal. O descumprimento destes preceitos, além de conduzir à apuração parcial das condutas, gera nulidades e prejuízos aos agentes acusados e à Administração Pública Estadual. Dois grandes fatores influenciam diretamente na interpretação equivocada da legislação especial, contrariamente aos ditames estabelecidos pelo Estado Democrático de Direito: a criação histórica da Polícia Militar e o sistema estrutural da Instituição baseado na hierarquia e na disciplina como valores fundamentais. |
| Abstract: | The investigation of serious disciplinary violations committed under the Military Police of Minas Gerais, by law, must respect due process of law and the rights and guarantees provided by Federal Constitution. Failure to comply with these principles, and lead to parcial verifications of pipelines, generates nullity and damages agents accused and State Administration. Two major factors directly influence the misinterpretation of special legislation, contrary to the dictates set by Democratic Rule of Law: the historical creation of the Military Police and the structural system of the institution based on hierarchy and discipline as core values. |
