| Resumo: | O presente estudo objetiva analisar a controvérsia doutrinária e jurisprudencial a respeito da adoção do termo de ajustamento de conduta na seara da improbidade administrativa. A partir do cenário constitucional de 1988 que elevou o Ministério Público à condição de tutor da sociedade e dos direitos coletivos, difusos e outros interesses indisponíveis, analisa-se a viabilidade da adoção de medidas extrajudiciais preventivas no campo da probidade administrativa com vistas a solucionar os obstáculos de acesso à justiça no âmbito da reprimenda civil de tais atos atentatórios à moralidade administrativa. |
| Abstract: | This study proposes to examine the doctrinal and jurisprudential controversy about the adoption of commitment/agreement term of conduct in cases of improbity conduct. From the scene of the 1988 Constitution that raised the Public Prosecution Office to the category of guardian of society and collective rights, and other diffuse interests unavailable, analyzes the feasibility of adopting preventive extrajudicial measures in the field of administrative probity in order to solve the justice access barriers in the field of civil reprimand of acts detrimental to the administrative morality. |
