Uma análise jurídica das ações e omissões das redes de televisão documentadas na obra “A criminalização do artista – como se fabricam os marginais em nosso país”

Abstract

The present work aims at briefly reflecting, regarding the outlines which involve the means of communication in the so-called information society, based on the novel “The criminalization of the artist – how the outcast people in our country are made”, which shortly underlines the status of the street craftsmen in the city of Belo Horizonte and the way they were portrayed by the media. For so, the analyses of the role of the media while informal instance of social control is timely, highlighting the criteria used for choosing what is going to be disclosed, its legal regulation currently, further to the narrow boundary between the freedom of information and the rights to honor, image and intimacy of the human being. After this discussion, we reach the issue about the legal consequences for damage to the important values for the human dignity in the civil sphere. At last, we move to the analyses of the case on the agenda, with the due focus in the profile assumed by the media and its legal implications.
