| Resumo: | O presente trabalho visa analisar os instrumentos fornecidos pelo ordenamento jurídico brasileiro para a tutela do tempo de forma eficiente, propugnando pela adoção de soluções não apenas repressivas, mas, também, preventivas, com o escopo de dar maior proteção ao referido bem jurídico. A partir de uma análise do ordenamento brasileiro e da corrente jurisprudência, aponta-se de forma crítica o alargado papel que tem sido atribuído à responsabilidade civil, especialmente por meio das ações individuais de indenização e da função punitiva do dano moral, e, por outro lado, a subutilização de outras soluções jurídicas, inclusive no âmbito administrativo, regulatório ou da tutela processual coletiva, que se mostram mais eficientes para a tutela do tempo dos sujeitos, sobretudo considerando-se a especial importância de tal bem na sociedade contemporânea. |
| Abstract: | The present work analyzes the tools provided by the Brazilian legal system for the protection of efficiently time, advocating the adoption of not just repressive solutions, but also preventive, with the aim of giving greater protection to such goods legal. From an analysis of the Brazilian legal system and current case law, it is pointed out critically the increased role that has been assigned to civil liability, especially through individual actions for compensation and punitive function of moral damages and, on the other hand, underutilization of other legal remedies, including at the administrative level, regulatory or collective procedural protection, which are more efficient for the protection time of the subject, especially considering the special importance of this well in contemporary society. |
