| Resumo: | O presente trabalho tem por objetivo perscrutar os fundamentos do posicionamento do direito brasileiro acerca da abrangência temporal da pronúncia judicial sobre a constitucionalidade de lei ou ato normativo. Nesse intento, serão abordadas diversas teorias sobre o tema, com foco especial na técnica da modulação dos efeitos da declaração de inconstitucionalidade. Para tanto, valemo-nos de antecedentes históricos do sistema de controle de constitucionalidade brasileiro, direito comparado, pesquisa bibliográfica e referências a importantes precedentes da Suprema Corte dos Estados Unidos da América e do Supremo Tribunal Federal. Após nos posicionarmos sobre cada uma das questões abordadas, concluímos que um dos maiores desafios dos sistemas de controle de constitucionalidade brasileiro e estrangeiros, não obstante suas peculiaridades, é encontrar o equilíbrio ideal entre a supremacia da Constituição e a segurança jurídica. |
| Abstract: | The present paper aims to examine the foundations of the Brazilian law position concerning the temporal reach of the judicial enunciation on the constitutionality of a law or a normative act. In this purpose, several theories on the theme will be approached, with special focus on the effects variation of the unconstitutionality declaration technique. To do so, we make use of historical antecedents in the Brazilian judicial review, comparative law, bibliographic research and references to important precedents of the Supreme Court of the United States of America and the Supreme Federal Court. After having positioned on each of the issues dealt, we concluded that one of the greatest challenges of the Brazilian and worldwide judicial review systems, regardless of their peculiarities, is to find the ideal balance between the supremacy of the Constitution and the legal certainty. |
