O diagnóstico genético pré-implantacional e o valor da vida embrionária para o Direito

Abstract

Human life is in constant development (construction), and due to the possibility of altering the future, by restarting and recommencing, one consists in innovation. We realize that technique constitutes human essence itself. Although none is essentially good or bad, each invention brings doubts to what would be their limits. Amongst countless techniques developed by man over the last decades, the human assisted reproduction, and more specifically, preimplantional genetic diagnosis, implicates a direct and decisive intervention over human being, and its use has caused, nonetheless, severalethical and legal heated discussions. In this context, where new technologies seems to suffocate ethics, we find on the law a possible way, and maybe the only one, to guarantee a man’s fundamental rights, being that there is only right when it is founded on someone and exists in order to recognize and protect this one. However, the lack of legal regulation persists, even after several bills suggested. Therefore, the intervention of the Law is urgent and needed in order to assure someone’s protection and dignity.
