| Resumo: | A gestação por substituição, utilizada como forma de livre planejamento familiar, perpassa por questões éticas e jurídicas de grande expressividade quando tal método procriacional torna-se objeto de contratos promovidos entre o casal desejante e a mãe sub-rogada, principalmente pelo fato de não haver uma normatização exauriente sobre o tema. Os acordos onerosos estabelecidos em tal sentido representam uma afronta a dignidade da pessoa humana, que é então vista como objeto de comércio e não absoluta em sua alteridade. O modo como a mercantilização do ser humano vai de encontro a uma ética baseada na ideia de responsabilidade ilimitada pelo Outro, pensamento elaborado pelo filósofo Emmanuel Lévinas, e como esse pressuposto ético torna o objeto contratual da maternidade por sub-rogação ilícito constituem a perspectiva e o método do trabalho em questão. |
| Abstract: | The gestational surrogacy, used as a form of family planning, permeates ethical and legal issues of great expressiveness when such procriational method becomes the object of contracts promoted between the wishing couple and the surrogate mother, mainly because there is no complete regulation on the subject. The onerous agreements in this regard represent an affront to human dignity, which is then seen as trading object and not absolute in its alterity. This monograph deals whith the way the human commercialization goes against an ethics based on the idea of a responsability unlimited by the Other, theory elaborated by the philosopher Emmanuel Lévinas, and how this ethical assumption makes the contractual object of subrogation motherhood unlawful. |
