| Resumo: | O presente trabalho tem por finalidade analisar os requisitos da união estável, com o enfoque no reconhecimento da união estável após a morte de um dos conviventes. Para o presente estudo foram consultados doutrinadores de renome sobre o assunto, bem como as legislações existentes e jurisprudências, abarcando também jurisprudências portuguesas. O intuito do estudo é buscar a segurança jurídica no que envolve ao reconhecimento e as possibilidade de fraude e divergências jurisprudenciais com enfoque na apresentação de novas possibilidade de requisitos para alteração por meio do legislativo e uma forma procedimental a fim de padronizar o procedimento de reconhecimento para o alcance da segurança jurídica de forma concreta. |
| Abstract: | This study aims to analyze the stable union requirements, with the focus on recognition of common-law marriage after the death of one of the cohabitants. For this study were consulted renowned scholars on the subject, as well as existing legislation and case law, also covering Portuguese jurisprudence. The study's objective is to find legal security in that it involves the recognition and the possibility of fraud and jurisprudential differences focused on presenting new possibilities requirements for change through the legislative and procedimental way order to standardize the recognition procedure for the scope of legal security in a concrete way. |
