| Resumo: | O presente Trabalho de Conclusão de Curso busca fazer uma análise da garantia do jus postulandi prevista na Lei dos Juizados Especiais Cíveis Estaduais em contraposição às discussões doutrinárias do acesso à Justiça, analisando, para tanto, fatores históricos, jurídicos, sociais e, em menor escala, práticos. Objetiva-se responder ao seguinte questionamento: O jus postulandi nos Juizados Especiais Cíveis Estaduais proporciona ao cidadão efetivo acesso à Justiça? Ao final, pretende-se demonstrar que, apesar da boa intenção legislativa em propiciar aos indivíduos o direito de postular junto aos Juizados nas causas de até 20 (vinte) salários mínimos, visando à efetivação do acesso à Justiça, esta decisão, em separado de outros mecanismos, pode até mesmo agravar as barreiras que inviabilizam o alcance da defesa dos direitos do cidadão. |
| Abstract: | This Course Conclusion aims to make an analysis of the jus postulandi guarantee provided by the Law of State Special Civil Courts as opposed to doctrinal discussions of access to justice, therefore, analyzing historical, legal and social factors also, to a lesser extent practical. It aims to answer the following question: Jus postulandi in the Small Claim Courts provides the effective citizen access to justice? At the end, we intend to demonstrate that, despite good legislative intent in providing individuals the right to claim from the Courts in cases of up to 20 (twenty) minimum wages, with a view to effective access to justice, this decision separately from other mechanisms may even aggravate the barriers that prevent the scope of protection of citizens' rights. |
